VIDEO | Court raps Police Inspector over hunter’s 'illegal' arrest Briffa was charged with violently assaulting a CABS official and causing him slight injury. German Cabs (Committee Against Bird Slaughter) official Axel Hirsehfeld, alleged in court before Magistrate Anthony Vella, that he was hit on the face by David Briffa while the hunter attempted to snatch his camera, to stop him from filming. Hirsehfeld explained how Briffa shouted “F*** Germany” numerous times before pursuing him. The incident took place yesterday in a car park near Mizieb, prior to which members from BirdLife and CABS were inspecting the area for dead birds. Inspector Paul Bond, who arrested Briffa himself, said the hunter gave a statement at around 5.40 pm after confiding with his Lawyer Arthur Azzopardi. In the statement, Briffa admitted he hit Hirsehfeld by mistake when trying to snatch his camera. In a cross-examination by Azzopardi, the Inspector admitted he had no warrant for arrest as he failed to inform his superiors of the incident. The lawyer said that Bond needed either a warrant by the police magistrate or had to fulfill certain criteria according to the Criminal Code in order to lawfully arrest Briffa. He argued that his client’s arrest was irregular and illegal according to law. Inspector Bond reiterated that it was his “duty and obligation” to maintain order and restrain the accused for breaking the law. Magistrate Vella ruled Briffa’s arrest was illegal and ordered his immediate release. The case will continue in Court on Thursday.
